El día de hoy les dejo un post para poner mi granito de arena, este trata de las iniciativas contra las personas y la libertad de expresión SOPA, ACTA y Ley Döring y del porque estoy en contra de estas, primero un eufemismo de la definición de estas leyes, lo que las personas que buscan crearlas quieren que pensemos que significan de manera muy retocada y linda.

Stop Online Piracy Act
(Español: Ley de cese a la piratería en línea) también conocido como Ley SOPA o Ley H.R. 3261; es un proyecto de ley introducido en la Cámara de Representantes de los Estados Unidos el 26 de octubre de 2011 por el representante Lamar S. Smith, y un grupo de copatrocinadores bipartidario formado inicialmente por 12 miembros. El proyecto de ley extiende las competencias del Departamento de Justicia de los Estados Unidos y amplía las capacidades de los propietarios de derechos intelectuales para combatir el tráfico online de contenidos y productos protegidos, ya sea por derechos de autor o de propiedad intelectual.

ACTA

(del inglés Anti-Counterfeiting Trade Agreement, traducido como Acuerdo comercial anti-falsificación) es un acuerdo multilateral voluntario que propone fijar protección y respaldo a la propiedad intelectual, casi de modo autocrático en la medida de que define lo que sí es permitido y lo que no, dígase de esto último todo lo que viole algún copyright, llegando a multar o incluso a enjuiciar el intento de esto. Principalmente, las empresas beneficiadas son las RIAA y MPAA, desvirtuando a entidades como Twitter, Youtube, Deviantart, Google, etc. por almacenar contenido con derechos protegidos u otorgados a un autor específico, por lo tanto, restringe la libertad de expresión.

La Ley Döring

Es el esfuerzo más reciente por parte del poder legislativo por crear una ley que controle y disminuya la piratería en internet (la versión mexicana de la ley sopa)

Suena bien?, pues no lo crean, ya que esto en palabras simples significa que si descargas una película que no es tuya o publicas, una película, canción, imagen, etcétera, que no te pertenece, incurrirías en una infracción. Que quede claro que esta infracción ocurriría así hagas o no hagas dinero con este material.

Argumentos en contra

-Amenaza a la libertad de expresión en Internet

-Impacto negativo en sitios web que alojan contenidos de usuario

-Debilitamiento de las protecciones de “puerto seguro” para sitios web

-Amenazas generales para los negocios relacionados con la web

-Amenaza para los usuarios que suben contenidos

-Amenaza para las redes internas

-Amenaza para el software de código abierto

Y al final todas estas resultan ineficacez para combatir la piratería:

Edward J. Black, presidente y Director Ejecutivo de la Computer & Communication Industry Association escribió en el Huffington Post que «Irónicamente, hay poco que podamos hacer para detener a los actuales sitios web dedicados a la piratería, los cuales simplemente reaparecen un par de horas después con un nombre diferente, y si se conoce públicamente su dirección numérica, incluso antes. Cualquiera que posea, o conozca esa dirección web numérica, es capaz de alcanzar el sitio web infractor, saltándose los controles.»

Una nota editorial en el periódico San Jose Mercury-News decía, «Imagínese los recursos necesarios para analizar cada una de las millones de ofertas de Google y Facebook cada día en busca de piratas que, si son encontrados, simplemente se mudan a otro sitio en prácticamente nada.»

Today I leave a post to put my two cents, this is the law against persons and freedom of expression called SOUP, ACTA and Law Döring and why I am against these, first a euphemismof the definition of these laws, which people behind this want us to think they mean a very retouched and cute definition in comparison to what they really mean.

Stop Online Piracy Act
(Spanish: Act to stop online piracy) also known as SOPA Act or HR Law 3261, is a bill introduced in the House of Representatives of the United States on October 26, 2011 by Rep. Lamar S. Smith, and a bipartisan group of cosponsors initially formed by 12 members. The bill extends the powers of the Department of Justice of the United States and extends the capabilities of intellectual property rights owners to combat online traffic content and products protected either by copyright or intellectual property.

ACTA
(English Anti-Counterfeiting Trade Agreement, translated as anti-counterfeiting trade agreement) is a voluntary multilateral agreement proposed to set back protection and intellectual property, almost autocratic manner to the extent that defines what it is allowed and what not, say the latter all that violates any copyright, leading to fine or prosecute even attempt this. Mainly, companies are benefiting RIAA and MPAA, nullifying entities such as Twitter, Youtube, Deviantart, Google, etc. to store protected content or rights granted to a specific author, therefore, restricts freedom of expression.

Ley Döring
It is the latest effort by the legislature to create a law to control and reduce internet piracy (the Mexican version of the law soup)

Sounds good?, it isn’t Because believe it or not, this in simple words means that if you download a movie that is not yours or public, film, song, image, etc. that is not yours, be guilty of a violation. It is clear that this breach happen and do not make money or material.
Arguments against
-Threat to freedom of expression on the Internet

-Negative impact on web sites that host user content

-Weakening protections “safe harbor” for websites

-General threats for web-related business

-Threat to users who upload content

-Threat to internal networks

-Threat to the open source software
And in the end these are inefficient to combat piracy:

Edward J. Black, president and CEO of the Computer & Communication Industry Association wrote in the Huffington Post that “Ironically, there is little we can do to stop the current web sites devoted to hacking, which simply reappear a few hours later with a different name, and if publicly known numerical address, even earlier. Anyone with, or know the Web address numbers, is capable of offending web site, bypassing the controls. ”

An editorial in the San Jose Mercury-News said, “Imagine the resources to analyze each of the million offers from Google and Facebook every day in search of pirates, if they are found, simply move to another site practically nothing. ”
